PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The applicant’s record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty) authenticated by his signature. His DD Form 214 indicates that he was discharged under the provisions of Chapter 14, AR 635-200 by reason of misconduct-a pattern of misconduct, with a characterization of service of general, under honorable conditions. Furthermore, the DD Form 214 shows a separation code of JKA (i.e., misconduct-a pattern of misconduct). The specific facts and circumstances leading to the applicant’s discharge are not contained in the available records.

         b. On 10 April 2000, the applicant was discharged. At the time of discharge, the applicant had completed 1 year, 3 months, and 23 days of active military service and had a total of 3 years, 9 months, and 23 days of active military service.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter l4 establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, but a general discharge under honorable conditions or an honorable discharge may be granted.

(1) The issue is rejected. The evidence of record shows and the statement provided by the applicant with his application confirms, that the applicant was properly discharged under the provisions of Chapter 14, Paragraph 14-12b, AR 635-200, by a reason of misconduct-a pattern of misconduct with a general, under honorable conditions characterization of service. The Board commends the applicant's on his successful transition to civilian life and noted the accomplishments outlined in his application. However, the Board found that these accomplishments did not overcome the reason for discharge and characterization of service granted. Further, the Board does not grant relief solely for the purpose of gaining employment or enhancing employment opportunities. The Board, being convinced that the reason of discharge and the characterization of service were both proper and equitable, voted to deny relief.
